1. Acceptance of Terms

By accessing or using the Full Funnel AI service ("Service"), operated by Techtix Agency ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

If you are using the Service on behalf of a dental practice, healthcare organization, or other entity, you represent that you have the authority to bind that entity to these Terms.

2. Service Description

Full Funnel AI provides an AI-powered voice receptionist platform designed for dental practices. The Service includes, but is not limited to:

• Automated phone call handling and appointment scheduling
• Call transcription and analysis
• Integration with practice management systems
• Marketing attribution and analytics
• Google Ads integration and optimization recommendations
• Dashboard access for managing calls, appointments, and analytics

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that may affect your use of the Service.

3. User Accounts and Responsibilities

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring that all users within your organization comply with these Terms
• Providing accurate information about your dental practice
• Maintaining proper patient consent for call handling and data processing

You must be at least 18 years old and have the legal authority to enter into this agreement. You may not share your account credentials or allow others to access your account.

4. Subscription and Billing

The Service is provided on a subscription basis. By subscribing to the Service, you agree to the following:

• Free Trial: New users may be eligible for a 14-day free trial. After the trial period, your subscription will automatically convert to a paid subscription unless cancelled.
• Billing Cycle: Subscriptions are billed monthly in advance. Your billing date is determined by your subscription start date.
• Payment: All payments are processed through Stripe. You authorize us to charge your designated payment method for all subscription fees and applicable usage charges.
• Price Changes: We may change subscription prices with 30 days advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
• Community Pricing: Our pricing may be adjusted based on the total number of active clinics using the Service. Discounts are applied automatically and may change as clinic participation fluctuates.
• Refunds: Subscription fees are non-refundable except as required by law or at our sole discretion.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service for any purpose other than dental practice operations
• Transmit any false, misleading, or fraudulent information
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to violate any applicable laws or regulations, including HIPAA
• Share, sell, or transfer your account to any third party
• Use the Service to make harassing, threatening, or abusive calls
• Circumvent or disable any security features of the Service
• Use automated systems to access the Service in a manner that exceeds reasonable use
• Reverse engineer, decompile, or disassemble any part of the Service

We reserve the right to investigate and take appropriate action against anyone who violates this policy, including removal from the Service and reporting to law enforcement authorities.

6. Healthcare Compliance

Full Funnel AI is designed to assist dental practices with administrative tasks. You acknowledge and agree that:

• The Service is not a substitute for professional medical judgment or advice
• You are solely responsible for compliance with all applicable healthcare laws and regulations, including HIPAA
• You must obtain appropriate patient consent before using the Service to handle patient communications
• You are responsible for verifying all AI-generated scheduling and information before taking clinical action
• We will enter into a Business Associate Agreement (BAA) with covered entities as required by HIPAA

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Techtix Agency and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any data you provide to the Service. By using the Service, you grant us a limited, non-exclusive license to use, store, and process your data solely for the purpose of providing and improving the Service.

We may use aggregated, anonymized data derived from your use of the Service to improve our products and services. This data will not identify you or your patients.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TECHTIX AGENCY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Errors or inaccuracies in AI-generated responses or scheduling
• Service interruptions or technical failures

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will function uninterrupted, secure, or available at any particular time or location, that any errors or defects will be corrected, that the Service is free of viruses or other harmful components, or that the results of using the Service will meet your requirements.

10. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through your account settings or by contacting our support team.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

Upon termination, we will retain your data for 30 days, during which you may request export of your data. After 30 days, we may delete your data in accordance with our data retention policies.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Vancouver, British Columbia, in accordance with the rules of the British Columbia International Commercial Arbitration Centre.
